1. About the ToonGod Website
These Terms apply to all users, including those who submit webtoon content or other materials. Our Website may include links to third-party sites not owned or controlled by ToonGod. ToonGod is not responsible for the content, privacy policies, or practices of these external sites, nor can we control or edit them. By using our Website, you acknowledge and agree that ToonGod is not liable for anything that happens on third-party sites. We advise you to read their terms and privacy policies when you visit them.

2. Website Access

  • A. Your Permitted Use: ToonGod grants you limited permission to use the Website for your personal, non-commercial use, provided you:
    • Do not copy or distribute any part of the Website without our written permission.
    • Do not alter or modify the Website, except as reasonably needed for its intended purpose.
    • Comply with all these Terms of Use.
  • B. Account Creation: Some features require an account. You must:

3. Intellectual Property Rights
All content on the ToonGod Website (excluding User Submissions, as defined below), including text, software, graphics, photos, sounds, music, videos, and logos (“Content” and “Marks”), is owned by or licensed to ToonGod and is protected by intellectual property laws. This Content is provided “AS IS” for your personal, non-commercial use only. You may not use, copy, reproduce, distribute, sell, or exploit it for any other purpose without prior written consent from the respective owners.

ToonGod retains all rights not explicitly granted. You agree not to use, copy, or distribute any Content, including other users’ submissions, for commercial purposes. If you download Content for personal use, you must keep all copyright and proprietary notices. You also agree not to bypass or interfere with any security features of the Website that prevent or restrict the use or copying of Content.

4. User Submissions

  • A. General: The ToonGod Website may allow you and other users to submit content, such as webtoons or other communications (“User Submissions”). While we host and publish these, we do not guarantee their confidentiality.
  • B. Your Responsibilities and Grant of License:
    • You are solely responsible for your User Submissions and the consequences of posting them. You confirm that you own or have all necessary rights (including intellectual property, privacy, and publicity rights) to your content and to grant ToonGod permission to use it as described here. This includes having written permission from anyone identifiable in your submission.
    • You retain ownership of your User Submissions.
    • However, by submitting content, you grant ToonGod a broad, worldwide, non-exclusive, royalty-free, sublicenseable, and transferable license to use, reproduce, prepare derivative works of, display, and perform your submissions in connection with the ToonGod Website and its business (including promotion and redistribution of the Website).
    • You also grant other ToonGod users a non-exclusive license to access and use your submissions through the Website’s features.
    • This license from you to ToonGod terminates if you remove or delete your User Submission from the Website.
  • C. Prohibited User Submissions: You agree not to submit content that:
    • Infringes on anyone else’s copyright, trade secret, or other proprietary rights, including privacy and publicity rights (unless you have permission).
    • Is false or misleading.
    • Is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages criminal behavior.
    • Is advertising or commercial solicitation.
    • Impersonates another person.
      ToonGod does not endorse any User Submission and is not responsible for their content or any opinions expressed.
      ToonGod does not permit copyright infringement. We will remove all content, including User Submissions, if properly notified of infringement. We will terminate the access of users who repeatedly infringe copyright. ToonGod also reserves the right to remove any content or terminate a user’s access at our sole discretion, without prior notice, for violations other than copyright infringement (e.g., for being pornographic, obscene, defamatory, or excessively long).
  • D. DMCA Copyright Infringement Notifications: If you are a copyright owner or agent and believe your copyright has been infringed, you may send a DMCA notice to our Copyright Agent at [email protected]. Your notice must include specific information as required by the DMCA (17 U.S.C. 512(c)(3)), including:
    • Your signature (physical or electronic).
    • Identification of the copyrighted work(s) claimed to be infringed.

TO THE FULLEST EXTENT PERMITTED BY LAW, TOONGOD (INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER THAT RESULT FROM:

7. Indemnity
You agree to defend, indemnify, and hold ToonGod (and its parent company, officers, directors, employees, and agents) harmless from any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) that arise from:

  • Your use of or access to the ToonGod Website.
  • Your violation of any part of these Terms of Use.
  • Your violation of any third-party right (e.g., copyright, property, or privacy right).
  • Any claim that your User Submission caused harm to a third party.
    This indemnification obligation continues even if you stop using the Website.

8. Ability to Accept Terms of Use
You confirm that you are at least 18 years old, an emancipated minor, or have legal parental/guardian consent, and are fully capable of agreeing to these Terms. Regardless, you must be over 13 years old, as the ToonGod Website is not intended for children under 13. If you are under 13, please do not use the Website.

9. Assignment
You may not transfer or assign your rights or obligations under these Terms. ToonGod, however, may transfer or assign its rights and obligations without restriction.
